1) The Difference Between Civil and Criminal

OBJECTIVES
Participants will be exposed to:
1) The differences between a civil and criminal legal suit
2) The types of punishments/penalties involved
3) Who initiates the action for both of these suits
4) The burden and standard of proof
5) The rights given to criminal defendants, which is not included in a civil suit

1) Differentiate between a civil suit and a criminal suit
2) Understand the types of punishments/penalties involved in these suits
3) Be familiarised with which parties initiate the legal proceeding involved in these suits
4) Understand and differentiate the burden and standard of proof involved in these suits
5) The rights given to a criminal defendant from the arrest up to the trial and sentencing

1) The different procedures involved in both Civil and Criminal suit
2) The courts involved
3) The process from the day the suit is filed up to the judgement / sentencing
4) The process of Appeal, if any

OBJECTIVES

2) Differentiate the ways of lodging a police report, i.e. in a police station or via e-Reporting
3) Understand and know in what situations can a person lodge a police report

5) Know what are the unnecessary elements to exclude when making your police report

5) Rights of Employer and Employee in the Police Investigation

OBJECTIVES
Participants will be exposed to:
1) The Investigation of Crime by Police
2) How does the Police recommends the Criminal Charges be filed against someone

6) Understanding your Rights - Suruhanjaya Syarikat Malaysia ("SSM")

OBJECTIVES

1) The Fundamental Liberties and the law that applies under the Companies Act 2016, Suruhanjaya Syarikat Malaysia ("SSM")
2) The law enforcement agency involved in SSM
3) The rights and duty to co-operate with the SSM as a Public
4) The relevant law involved in the SSM procedure and approach

1) Know and understand the Fundamental Liberties and the law that applies
2) Know the law enforcement agency involved in Suruhanjaya Syarikat Malaysia (SSM)

2) When should a Domestic Inquiry be conducted

6) The significance of a show cause letter
7) The format relating to Notice of Inquiry
8) Who should be appointed as panel for Domestic Inquiry

1) Understand the importance of Domestic Inquiry
2) Understand the proper procedure in conducting Domestic Inquiry

4) Be familiar with the correct and proper format of the Notice of Inquiry

6) Understand how to reply to the show cause letter
7) Understand the Appointment of Panel for Domestic Inquiry

8) Understanding your rights - Enforcement Agencies

OBJECTIVES
Participants will be exposed to:
1) Anti-Corruption Process Under the Malaysian Anti-Corruption Commission ("MACC"), particularly under Section 17A of MACC Act
2) The Royal Malaysian Customs ("RMC"), which includes the laws enforced by RMC and the proper procedure of the RMC.
   
LEARNING OUTCOMES
Upon the completion of this lesson, participants will be able to:
1) Understand the role of MACC as the Enforcement Agency
(a) Know in depth and understand the act of corruption and the duty to report it.
(b) Understand the offences involved under the MACC Act (i.e. bribery, giving and accepting gratification, abetment and etc).
(e) Know the power of MACC in investigation, search, seizure and arrest.
2) Understand the role of RMC as the Enforcement Agency
(a) Understand and know their rights, if and when encountered with the RMC
(b) Know the powers of the Custom Officers and understand the laws and procedure involved
3) Familiarise and understand of their obligation and right as a Public when encountering with the Enforcement Agencies
4) Know any penalty involved, if and when they refused to comply with the Enforcement Agencies

That is the purpose of "You and The Law" which is to explain the law to the participants a simple, easy-understanding language. This course will assist you in handling your daily life in functioning effectively in the complex society by being legally literate. This program is organised in a way to educate everyone about those areas of law that involves in your day to day live.

Years ago, the workplace was, for the most part, unregulated. However, today, the state and federal laws regulate the employees and employers alike. The law affects every aspect of work by helping to shape the relationship between the employer and the employee.

Throughout the programme, one will be exposed to the legal system which explains the steps involved in most civil and criminal cases, that is the procedures common to most of them. This will also assist the participants to understand the legal system as a whole.

Throughout the programme, we will also explain the key points involving the civil and criminal justice system, which involves the differences, the legal processes and representations. In regards to the criminal justice system, one will also be educated on the lodging of police report and police investigations. Participants will also be exposed to employers' and employees' rights and the law relating domestic inquiry.

However, one should be aware that by attending this Programme, one cannot pretend to give legal advice upon the completion of this course as only a lawyer who understands the facts of that particular case is able to do so. In addition, although every effort has been made to present material that is up-to-date as possible, all laws can and do change regularly. Decisions by state and federal courts, as well as regulations from government agencies at all levels, also can change how laws are interpreted and applied.

Therefore, the information received from this programme should be considered as an introduction to and knowledge in the areas of laws, rather than the final word on, the law in each area. Armed with the knowledge and insights provided in "You and The Law", one can have more confidence that the legal decisions made will be in their best interest.
